For the purposes of these terms, "Pulse" refers to the company Pulse Reviews Limited, a UK registered company with the registration number 15467356.

"Service" refers to the Pulse software platform, its associated features, and any services or functionality provided by Pulse, including but not limited to tools for managing user accounts, processing Google location data, collecting and displaying reviews, and any related services or products offered under the Pulse brand. This includes all updates, enhancements, or modifications to the software that may be introduced from time to time.

"User" refers to any individual, organisation, or entity who accesses or uses the Pulse service. This includes anyone who registers an account, logs in, or interacts with the platform in any way, whether for personal, professional, or business purposes. Users may be end customers, administrators, or authorised agents accessing the service.

"Content" refers to any and all data, information, text, images, software, photographs, graphics, videos, messages, comments, reviews, tags, or any other materials submitted, uploaded, posted, or made available by Users or third parties within the Pulse service. This includes user-generated content, as well as any content retrieved or aggregated by the service from third-party platforms, such as Google.

To use our services, you must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is greater. By accessing or using our services, you represent and warrant that you meet the eligibility requirements. If you are under the age of 18, you are not permitted to use our services.

You are solely responsible for maintaining the confidentiality and security of your account information, including your username, password, and any other credentials associated with your account. You agree to immediately notify us of any unauthorized use or breach of security related to your account. You are also responsible for all activities that occur under your account, whether or not authorised by you.

You retain full ownership of any content you post, upload, or otherwise submit to our service, including but not limited to data, text, images, video, and other materials. By posting content, you grant Pulse a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with providing, promoting, and improving the service. This license allows Pulse to use the content in any media or format, including for marketing, educational, or promotional purposes, without compensation to you. You also represent and warrant that you have the necessary rights to grant this license.

You agree not to post, upload, or share any content that is illegal, harmful, abusive, harassing, defamatory, obscene, offensive, or otherwise violates the rights of others. This includes but is not limited to content that infringes upon intellectual property rights, promotes hate speech, or contains harmful malware or viruses. Pulse reserves the right to remove or disable access to any content that violates these guidelines, and to suspend or terminate accounts involved in such activity, without prior notice.

We collect and use your data as described in our Privacy Policy. This includes personal information you provide when registering for the service, as well as data generated through your use of the platform, such as information related to your Google locations, reviews, and media. By using our service, you consent to the collection and use of your data in accordance with our Privacy Policy.

We take reasonable steps to implement appropriate security measures to protect your data from unauthorised access, alteration, or destruction. This includes encryption, access controls, and other security protocols. However, please be aware that no system or method of data transmission over the internet can be guaranteed to be completely secure. While we strive to maintain a high level of security, we cannot guarantee absolute security of your data.

We may share publicly accessible information, such as reviews and publicly available location data, for use in marketing, social media, and public relations campaigns. This could include showcasing customer feedback or location details in promotional materials. We will never share any confidential or private information, and any such sensitive information will be stored securely and not disclosed without your consent.

We do not collect, store, or process credit card information directly. Instead, we use a third-party payment processor, Stripe, to handle all credit card transactions. Stripe adheres to the highest standards of security and compliance to protect your payment information, and we do not have access to your full credit card details.

All intellectual property rights in and to the service, as well as any content, software, designs, and materials provided by Pulse, excluding user-generated content, are the exclusive property of Pulse or its licensors. This includes all rights to the Pulse platform, its website, software, trademarks, logos, and any associated content or materials. Users are granted only a limited, non-exclusive, non-transferable right to use the service as outlined in these Terms, and all rights not expressly granted are reserved by Pulse or its licensors.

You may not copy, modify, reproduce, distribute, sell, lease, or otherwise exploit any part of our services, including any included software, unless expressly authorized by Pulse. Additionally, you may not reverse engineer, decompile, disassemble, or attempt to extract the source code of any software provided as part of the service, except to the extent that such actions are expressly permitted by applicable law. Any attempt to circumvent or violate these restrictions may result in the termination of your account and legal action.

We encourage users and visitors to share valuable information they find on our site, provided that it is done in a respectful manner and that Pulse is properly credited. We appreciate reviews and user-generated content that helps spread the word about Pulse and the services we provide. If you enjoy our platform, sharing your positive experience with others is always welcome and helps us grow our community.

While we strive to ensure the availability of our service, we do not guarantee 100% uptime. Like any online service, our platform may experience intermittent downtimes or disruptions due to unforeseen issues, server maintenance, or external factors. We are committed to minimizing downtime and resolving issues as quickly as possible, but we cannot be held liable for any service interruptions.

From time to time, we may need to perform scheduled or unscheduled maintenance on our platform. This maintenance could temporarily interrupt the service or result in periods of reduced functionality. We will make reasonable efforts to notify users of planned maintenance in advance, but we cannot guarantee prior notice for unexpected maintenance or issues that arise. By using our service, you acknowledge and accept the possibility of temporary interruptions.

To ensure optimal performance and reliability, we use a service called OhDear for comprehensive monitoring of our platform. This includes tracking uptime, performance metrics, SSL certificate health, broken links, Google Lighthouse scores, scheduled tasks, DNS health, and more. This monitoring allows us to proactively address potential issues and improve the overall user experience.

You have the right to terminate your account at any time by following the appropriate process in the service settings or contacting us directly. Upon termination, your access to the service will be revoked, and any data or content associated with your account may be deleted in accordance with our Privacy Policy. Please note that termination of your account does not relieve you of any outstanding payments or obligations incurred prior to the termination.

We reserve the right to terminate or suspend your account at our discretion if you violate these Terms and Conditions or engage in any activity that we believe may harm Pulse, its users, or its reputation. This includes but is not limited to activities such as violating intellectual property rights, posting prohibited content, or engaging in fraudulent or abusive behavior. In the event of termination, you will be notified of the reason for the suspension or termination, and your access to the service may be revoked immediately. We are not responsible for any loss of data or services that may result from the termination of your account.

Pulse will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or other intangible losses, whether incurred directly or indirectly, arising from your use or inability to use the service. This includes, but is not limited to, any unauthorized access to or use of our servers, systems, and any personal information stored therein. Pulse is not responsible for any errors, omissions, or interruptions in the service, or any third-party services integrated with the platform. Furthermore, Pulse’s liability will be limited to the amount you paid, if any, for accessing the service in the last six months before the claim arose. This limitation of liability applies regardless of the cause of action, whether in contract, tort (including negligence), or otherwise.

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles. Any disputes arising out of or relating to these terms or the use of our services shall be subject to the exclusive jurisdiction of the courts in the United Kingdom.

We reserve the right to modify or update these terms at any time, at our sole discretion. Any changes will be posted on this page with an updated revision date. It is your responsibility to review these terms periodically to stay informed of any updates. By continuing to use the service after any modifications are made, you acknowledge and agree to the revised terms.
